16 anos e cinco anos de contrato – Como o Flu conseguiu assinar o primeiro contrato com Arthur por tanto tempo? Explicamos!
O meia Arthur, após se tornar o jogador mais jovem da história a vestir a camisa do Fluminense, hoje, assinou o seu primeiro contrato profissional com o tricolor por mais cinco anos. Contudo, o fato que chamou mais atenção foi o tempo do vínculo assinado. A diretoria tricolor vinha mantendo diálogos com a CBF e soube que a entidade tem registrado alguns contratos de cinco anos com atletas de 16 anos, com base no que permite a Lei Pelé.
Mês passado, o presidente tricolor, Mário Bittencourt, chegou a ter uma reunião com o presidente Rogério Caboclo para apresentar uma sugestão para ser levada à FIFA para tentar alterar a legislação para jovens jogadores e dar mais proteção aos clubes formadores.
Hoje, a Lei Pelé permite que atletas com menos de 18 anos assinem seus primeiros contratos profissionais com os clubes por cinco anos. A FIFA, entretanto, só aceita por três anos, o que para muitos empresários é o suficiente para valorizar o jogador.

Mas por qual motivo os clubes (até o próprio Fluminense) só vem assinando contrato de três anos com a maioria dos atletas da base? Ocorre que a CBF vem aceitando registar contrato de cinco anos caso seja com a concordância de ambas as partes, o que não impede que o atleta saia com o contrato de três anos, verificado pela FIFA. É difícil, mas não impossível.
No caso do Arthur, o Fluminense propôs o de cinco anos e como a família acredita no projeto do clube, aceitou. Com isso, foi acordado entre as partes que quando ele fizer 18, se ainda estiver no Flu, vão sentar para fazer um novo contrato.
O “Regulamento sobre condição e transferência de jogadores” da Fifa estabelece que:
“A duração mínima de um contrato será a partir da sua data de vigência até o final da temporada, enquanto a duração máxima de um contrato será de cinco anos. Contratos de qualquer outra duração só serão permitidos se forem consistentes com as leis nacionais. Jogadores menores de 18 anos não podem assinar um contrato profissional por um período superior a três anos. Qualquer cláusula referente a um período mais longo não será reconhecida”.
Enquanto a Lei Pelé tem a seguinte redação:
“A entidade de prática desportiva formadora do atleta terá o direito de assinar com ele, a partir de 16 (dezesseis) anos de idade, o primeiro contrato especial de trabalho desportivo, cujo prazo não poderá ser superior a 5 (cinco) anos”
Hoje, como está sendo visto, o Flu vem fazendo um grade trabalho com sua categoria de base. Até o momento, de acordo com números da nossa reportagem, mais de 80 jogadores já tiveram seus primeiros contratos assinados e até renovados com o clube, e isso está gerando uma visão melhor até mesmo dos representantes dos atletas sobre o projeto apresentado pela diretoria aos empresários.
