URGENTE – Decisão da Taça Guanabara será com portões fechados
A decisão da Taça Guanabara de 2019, que será decidida entre Fluminense e Vasco da Gama, às 17h, no Maracanã, não terá a presença do que faz o esporte ter significado: torcida. Em decisão preferida agora há pouco, a desembargadora de plantão, Exma. Lúcia Heleno do Passo, determinou que o jogo ocorra de portões fechados, acatando pedido feito pelo corpo jurídico do Fluminense, garantindo-se, assim, a segurança dos torcedores dos dois clubes. A magistrada ainda fundamenta a sua decisão como uma medida pedagógica, uma vez que, na opinião dela, não houve civilidade no tratamento do assunto entre as partes envolvidas. A desembargadora ainda arrumou espaço para criticar o posicionamento público das partes que teria acirrado os ânimos de seus torcedores, que poderia culminar com enfrentamentos nas ruas da Cidade.
Os torcedores que adquiriram ingressos para a partida serão ressarcidos, apesar de a decisão não apontar como se dará tal procedimento, ficando a cargo do Vasco da Gama, organizador da partida por ser o mandante dela, defini-lo.
Apesar de a decisão não ser a esperada pelos torcedores tricolores, trata-se de uma vitória jurídica para o Fluminense, que teve seu pedido acatado pela desembargadora, ainda que parcialmente, já que o clube também pedira o aumento da multa estipulada em caso de venda de ingressos para a torcida do Vasco para o setor Sul do Maracanã, o que não foi acatado.

AGRAVO DE INSTRUMENTO Nº 00037549-75.2019.8.19.0001
AGRAVANTE: CLUB DE REGATAS VASCO DA GAMA (CRVG)
AGRAVADO: FLUMINENSE FOOTBALL CLUB
INTERESSADO: CONSÓRCIO MARACANÃ ENTRETENIMENTO S.A.
DESEMBARGADORA DE PLANTÃO: LUCIA HELENA DO PASSO
DECISÃO
Trata-se de agravo de instrumento com pedido liminar interposto por CLUB DE REGATAS VASCO DA GAMA (CRVG), na qualidade de terceiro prejudicado, contra decisão do Juízo de 37ª Vara Cível da Comarca da Capital, nos autos de processo n° 00072675-60.2017.8.19.0001, em que são partes exclusivamente o FLUMINENSE FOOTBALL CLUB (FFC) e o CONSÓRCIO DO MARACANÃ, proferida no dia 15 de fevereiro de 2019, nos seguintes termos: “(…) impõe-se o deferimento da tutela de urgência a fim de que a parte ré dê cumprimento ao contrato em sua integralidade garantindo que a torcida da parte autora se posicione no setor sul do Maracanã, sob pena de multa de R$50.000,00 por hora de venda de ingresso em desacordo ao ora estabelecido, determinando-se por outro lado expedição de oficio ao Clube de Regatas Vasco da Gama e Federação de Futebol do Estado do Rio de Janeiro, comunicando-se a presente decisão, a fim de que a venda de ingressos no setor sul seja reservada aos torcedores do Fluminense, autorizando-se que o patrono da parte retire oficio junto ao cartório. Intime-se COM URGÊNCIA pelo plantão diurno, na forma do artigo 192, inciso IX da Consolidação Normativa.” (fls.1319 dos autos originários).
Nos termos da referida decisão, ora agravada, deverá ser assegurado o setor sul do estádio do Maracanã à torcida do Clube Fluminense, no próximo jogo do dia 17 de fevereiro, em que disputará com o Clube Vasco da Gama. Para fundamentar sua decisão, o Juízo a quo amparou-se em anterior acórdão proferido pela Décima Sexta Câmara Cível que determina a manutenção dos efeitos do contrato firmado entre o Clube Fluminense e o Consórcio Maracanã, com a ultratividade do 4º aditivo anexado aos autos. Acrescenta o magistrado que tais instrumentos contratuais assegurariam a preferência ao Clube Fluminense para destinar o setor sul do estádio à sua torcida (acórdão às fls.113/126 dos autos do agravo de instrumento nº 0015955-76.2017.8.19.0000).
Inconformado, o Clube Vasco da Gama, ora Agravante, sustenta que o Juízo a quo não atentou para um dado relevante que afastaria por completo as premissas tomadas na decisão agravada, qual seja, o fato de o Vasco ser o mandante do jogo, ou seja, é ele o clube responsável por alugar o estádio para a partida contra o Fluminense no dia 17 de fevereiro próximo, estando entre suas atribuições exclusivas o pagamento do aluguel, a organização do jogo, a venda de ingressos, a operacionalização da segurança, enfim, toda a infraestrutura necessária para a realização da partida.
Argumenta, ainda, que as cláusulas contratuais dos instrumentos firmados pelo Fluminense com o Consórcio Maracanã, inclusive a que assegura preferência para o setor sul do estádio, partem do pressuposto de que seriam jogos em que o Fluminense atuaria como mandante, o que não é o caso dos autos (vide cláusula V das Considerações Iniciais do Contrato e Cláusula 1.3.).
Acrescenta que mais de 11 mil ingressos já foram vendidos, sendo a maior parte deles destinada ao setor sul, de sorte que a manutenção da decisão agravada poderia frustrar direitos dos torcedores que já adquiriam seus ingressos e, ainda, colocar em risco toda a logística de segurança já montada para a partida.
Requer, em sede de plantão, a concessão de efeito suspensivo ao recurso a fim de permitir a execução do plano de jogo tal como submetido pelo Agravante e aprovado pelas entidades envolvidas no evento.
Em resposta, o Clube Fluminense apresenta petição neste regime de plantão manifestando-se sobre o presente agravo de instrumento. Alega que desde 2013, quando da assinatura do Contrato de Licença de Direitos e Uso do Estádio para Realização de Partidas de Futebol e Outras Avenças, firmado entre este Clube e o Consórcio Maracanã, foi garantido aos torcedores tricolores o direito sobre o setor sul do estádio, nos termos do anexo V, direito este que, a despeito das disputas entre os times, vinha sendo tradicionalmente observado nas partidas da qual o Fluminense participava, na qualidade de mandante ou não.
Aduz que o rompimento dessa tradição, bem como a inobservância da cláusula contratual, significará ofensa à segurança dos torcedores, razão por que requer que a partida ocorra com portões fechados, sem torcidas, ou alternativamente, a interdição dos setores Sul e Norte, tendo em vista o risco de conflitos entre os torcedores, já noticiado amplamente na imprensa e redes sociais. Requer, ainda, a intervenção do Ministério Público, a majoração da multa aplicada ao Agravante, bem como a busca e apreensão dos ingressos impressos à torcida do Vasco da Gama.
É O RELATÓRIO. DECIDO.
Para a concessão de efeito suspensivo faz-se necessária a demonstração de probabilidade de provimento do recurso, bem como do risco de dano grave, de difícil ou impossível reparação em razão da produção de efeitos da decisão atacada, conforme determina o artigo 995, parágrafo único, CPC, in verbis:
Art. 995. Os recursos não impedem a eficácia da decisão, salvo disposição legal ou decisão judicial em sentido diverso.
Parágrafo único. A eficácia da decisão recorrida poderá ser suspensa por decisão do relator, se da imediata produção de seus efeitos houver risco de dano grave, de difícil ou impossível reparação, e ficar demonstrada a probabilidade de provimento do recurso.
No caso em exame, o risco de dano é evidente, pelos fundamentos expostos a seguir.
Verifica-se que a decisão do Juízo a quo faz referência à necessidade de observância do acórdão proferido pela Décima Sexta Câmara Cível no julgamento do agravo de instrumento nº 0015955-76.2017.8.19.0000 (fls.113/126).
Ocorre, porém, que uma leitura atenta do referido acórdão (index 113) revela que o julgamento não apreciou nem longe o tema da localização das torcidas nos setores do estádio, mas ocupou-se em enfrentar a questão da validade e eficácia do contrato e aditivos firmados entre o Clube Fluminense e o Consórcio Maracanã, bem como as alegações de desequilíbrio contratual, determinando, por fim, a manutenção dos efeitos do contrato firmado entre o Clube Fluminense e o Consórcio Maracanã (index 147), com a ultratividade do 4º aditivo anexado aos autos (index 469).
Ressalte-se, antes de mais nada, que a interpretação sistemática do contrato firmado entre o Clube Fluminense e o Consórcio Maracanã indica que a premissa das cláusulas ali contidas é a de que seriam partidas tendo o Fluminense como mandante do jogo, conforme cláusula V das considerações iniciais do contrato, a saber:
“O FLUMINENSE tem interesse em utilizar o Estádio, pelo período de vigência do Contrato de PPP, para realizar todas as partidas de futebol em que for considerado como mandante pelas Entidades de Administração do Desporto ou entidades organizadoras de Campeonatos Oficiais da referida modalidade;”
Na realidade, compulsando os autos, verifica-se que a controvérsia em torno da preferência pelo setor sul do estádio do Maracanã decorre da cláusula que consta do Anexo V do contrato firmado entre o Clube Fluminense e o Consórcio, que dispõe in verbis:
“Nas Partidas Oficiais, contra quaisquer outros dos Principais Clubes do Rio de Janeiro, a torcida do FLUMINENSE acessará e se posicionará no setor Sul do Estádio (lado UERJ), em sua integralidade, através das entradas, acessos e rampas correspondentes e disponíveis para esse setor, salvo haja ordem expressa em sentido contrário por parte de: (i) Órgãos Públicos especificamente por questões de segurança; (ii) salvo acordo expresso entre o FLUMINENSE e a equipe visitante; e (iii) nos casos em que o FLUMINENSE for visitante, a CONCESSSIONÁRIA poderá, para fins comerciais, mediar acordo entre o FLUMINENSE e o clube mandante, resguardados os direitos do FLUMINENSE previstos neste contrato”
Logo, os argumentos suscitados pelo Clube Fluminense – no sentido de descumprimento do acórdão da Décima Sexta Câmara Cível e de violação da cláusula contratual que lhe asseguraria preferência no setor sul – são absolutamente inconsistentes.
Aplica-se ao caso em tela a ressalva prevista no item (iii) acima destacada, visto que no evento em questão o Clube Fluminense não atuará como mandante, sendo tal posição ocupada pelo Clube Vasco da Gama.
Neste sentido, verifica-se que tanto a Concessionária (Consórcio Maracanã) quanto o mandante do jogo (Clube Vasco) defendem que a torcida vascaína ocupe o setor sul do estádio – sem haver, contudo, concordância do Clube Fluminense.
Inexistindo acordo entre as partes, conclui-se que o contrato é omisso quanto à hipótese que se apresenta. Destarte, é o caso de aplicar-se a ressalva prevista no item (i) da mesma cláusula, tendo em vista as questões de segurança que envolvem a controvérsia.
Por outro lado, não se pode fechar os olhos para a tradição das torcidas dos times e, consequentemente, para o fato de que nos últimos anos os torcedores tricolores vêm ocupando o setor sul do estádio do Maracanã, em partidas em que o Clube Fluminense atua como mandante ou visitante.
Da mesma maneira, não se pode ignorar as notícias veiculadas na imprensa, bem como manifestações publicadas em redes sociais na data de hoje, que apontam para o risco iminente de confronto e violência entre as torcidas do Vasco da Gama e do Fluminense na partida do dia 17 de fevereiro em razão da disputa pelo setor sul.
Acrescenta-se, aqui, o repúdio desta magistrada a manifestações públicas de representantes e dirigentes de clubes que acirram o conflito posto e, agressivamente, incitam a violência entre os torcedores, afastando-se dos ideais desportivos.
E, ainda, deve ser levado em conta o fato de que mais de 11 mil ingressos já foram vendidos, segundo documentos trazidos pelo Agravante Vasco, sendo parte expressiva desses destinada ao setor sul do estádio.
Lamentavelmente, portanto, a decisão que exsurge como prudente e razoável é determinar a realização do jogo a portas fechadas, sem a presença de torcidas, de modo a evitar a violência no evento, que se revela como risco iminente.
Ademais, trata-se de medida pedagógica para as partes envolvidas (Vasco da Gama, Fluminense e Consórcio Maracanã), para que, na organização de eventos futuros, façam prevalecer os valores que envolvem o esporte, pautando-se pelo diálogo e civilidade.
Por tais fundamentos, DEFIRO PARCIALMENTE A LIMINAR para atribuir efeito suspensivo à decisão agravada e determinar que a partida entre os Clubes Fluminense e Vasco da Gama, marcada para o dia 17 de fevereiro de 2019, seja realizada a portas fechadas, sem a presença de torcidas, determinando-se a devolução dos valores pagos pelos torcedores que já adquiriam os ingressos.
Determino, por fim, a expedição de oficio / mandado para a Secretaria de Estado de Segurança Pública / Batalhão de Polícia Militar responsável, para que tome todas as providências destinadas ao reforço da segurança no evento. Assine-se por ordem.
